Welcome, and thank you for your interest in Polar, a product of Recursive Intelligence, Inc. ("Recursive Intelligence," "we," or "us"). These Terms of Service ("Terms") govern your access to and use of the Polar browser, Polar agent features, our website, APIs, and related services (collectively, the "Services"). By using the Services, you agree to these Terms.
Please also read our Privacy Policy, which explains how we collect, use, disclose, and process personal data.
If you are entering into these Terms on behalf of an entity, you represent that you have the legal authority to bind that entity.
1. Access and Use
1.1 Provision of Access. Polar is an AI browser assistant that performs browser-based tasks on your behalf. Subject to your compliance with these Terms, Recursive Intelligence grants you a limited, non-exclusive, non-transferable right to access and use the Services.
1.2 Inputs and Outputs. You may provide prompts, instructions, files, and other content to the Services ("Inputs"), and receive responses, completed tasks, generated content, or other results ("Outputs"). Inputs and Outputs are collectively referred to as "Content." We may use Content to provide the Services, comply with applicable law, enforce our terms and policies, and keep the Services safe. By submitting Inputs, you represent and warrant that you have all rights, licenses, and permissions necessary for us to process the Inputs to provide the Services.
1.3 AI Limitations. You acknowledge that Outputs are generated by AI and may contain errors, omissions, or inaccuracies. You are solely responsible for reviewing, evaluating, and bearing all risks associated with your use of any Output. Polar Outputs are not professional legal, financial, medical, or other regulated advice.
1.4 Use Restrictions. You may not: (i) reverse engineer, decompile, or otherwise attempt to extract the source code or underlying structure of the Services; (ii) reproduce, modify, or create derivative works of the Services; (iii) use the Services to develop or train a competing AI product or service; (iv) use the Services to generate content that violates applicable law or infringes any third-party rights; (v) probe, scan, or attempt to penetrate the Services; (vi) harvest or scrape data from the Services in an unauthorized manner; (vii) use the Services to send spam, engage in phishing, or conduct any fraudulent activity; or (viii) knowingly permit any third party to do any of the foregoing.
1.5 Beta Features. From time to time, we may make beta or early-access features available. Such features are provided on an "as-is" basis, may be discontinued at any time, and are not subject to any service-level commitments. Use of beta features is at your own risk.
2. Eligibility
You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you are at least 18 years old and that your use complies with all applicable laws in your jurisdiction.
3. Account Registration
To access most features, you must create an account. You agree to provide accurate and complete information when registering and to keep your account information up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. 4. Payment Terms
4.1 Fees. Certain features of the Services require payment. Applicable fees are displayed before purchase. All fees are in U.S. dollars and, except as required by law, are non-refundable, except at our sole discretion.
4.2 Subscriptions. Some plans are offered as automatically renewing subscriptions. Your subscription will renew at the end of each billing period unless you cancel before the renewal date. You may cancel at any time through your account settings.
4.3 Payment Processing. Payments are processed by Stripe, Inc. By making a purchase, you agree to Stripe's terms and privacy policy.
4.4 Price Changes. We may change our prices at any time with notice. Your continued use after a price change takes effect constitutes your agreement to pay the new price.
5. Ownership and Licenses
5.1 Our Services. Recursive Intelligence and its licensors retain all right, title, and interest in the Services and all associated intellectual property.
5.2 Your Content. You retain all right, title, and interest in your Inputs. To the extent Recursive Intelligence has any rights in Outputs generated in response to your Inputs, Recursive Intelligence hereby assigns those rights to you, subject to these Terms.
5.3 Feedback. If you provide feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.
5.4 Usage Data. We may collect and use aggregated, de-identified data about how users interact with the Services for any lawful business purpose, including to improve and develop our products and services.
6. Third-Party Services and Connected Accounts
The Services may incorporate or connect to third-party services, platforms, or applications. If you connect a third-party account (such as Google, Slack, or others) to the Services, you authorize Polar to access and act on that account on your behalf as directed by your tasks. Your use of any third-party service is subject to that service's own terms and privacy policy. Our use of data from connected accounts is described in our Privacy Policy.
7. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not use the Services to generate or distribute illegal content, harass or harm any person, violate third-party rights, impersonate any person or entity, or interfere with the security or integrity of the Services or any third-party systems.
8. Modifications
8.1 Terms. We may modify these Terms from time to time. We may notify you of changes by updating the effective date or by other reasonable means. Your continued use after changes take effect constitutes acceptance.
8.2 Services. We may modify, suspend, or discontinue any part of the Services at any time, with or without notice.
9. Termination
You may stop using the Services at any time. We may suspend or terminate your access at any time for any reason, including violation of these Terms. Sections 5, 10, 11, 12, and 13 will survive termination.
10. Copyright
If you believe that content in the Services infringes your copyright, please contact us at hello@polarbrowser.com with a description of the infringed work, location of the infringing material, your contact information, and a statement of good-faith belief that the use is unauthorized.
11. Disclaimer of Warranties
THE SERVICES AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. RECURSIVE INTELLIGENCE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RECURSIVE INTELLIGENCE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES.
RECURSIVE INTELLIGENCE'S TOTAL AGGREGATE LIABILITY TO YOU WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) $100.
13. Dispute Resolution
13.1 Informal Resolution. Before filing a formal claim, contact us at hello@polarbrowser.com. We will attempt to resolve the dispute within 30 days.
13.2 Governing Law. These Terms are governed by the laws of the State of California. You and Recursive Intelligence submit to the exclusive jurisdiction of the state and federal courts in San Francisco, California.
14. Miscellaneous
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Recursive Intelligence regarding the Services. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets, without your consent. If any provision is unenforceable, the rest remains in full force. Our failure to enforce any right is not a waiver. You must comply with all applicable export and trade laws.
